We securely store the data uploaded by users to our platform within amazon web services, ensuring its confidentiality and integrity. Users have the option to delete their data at any point, inclusive of both the data uploaded and chat messages. Unlike chatgpt, your data and chats are never sent to openai to be used for model training purposes.

We do not process sensitive information.

Payment Data.

We may collect data necessary to process your payment if you make purchases, such as your payment instrument number, and the security code associated with your payment instrument. All payment data is stored by Stripe. You may find their privacy notice link(s) here: https://stripe.com/privacy.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

10. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

11. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with Services, you have the right to request removal of unwanted data that you publicly post on the Services. To request removal of such data, please contact us using the contact information provided below and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Services, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g., backups, etc.).

CCPA Privacy Notice

Will your information be shared with anyone else?

We may disclose your personal information with our service providers pursuant to a written contract between us and each service provider. Each service provider is a for-profit entity that processes the information on our behalf, following the same strict privacy protection obligations mandated by the CCPA. We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be "selling" of your personal information. We have not disclosed, sold, or shared any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months. We will not sell or share personal information in the future belonging to website visitors, users, and other consumers.

Your rights with respect to your personal data

1. Right to request deletion of the data — Request to delete You can ask for the deletion of your personal information. If you ask us to delete your personal information, we will respect your request and delete your personal information, subject to certain exceptions provided by law, such as (but not limited to) the exercise by another consumer of his or her right to free speech, our compliance requirements resulting from a legal obligation, or any processing that may be required to protect against illegal activities.

4. Right to Limit Use and Disclosure of Sensitive Personal Information We do not process consumer's sensitive personal information.

Verification process

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g., phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

Other privacy rights

• You may object to the processing of your personal information.
• You may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the information.
• You can designate an authorized agent to make a request under the CCPA on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with the CCPA.
• You may request to opt out from future selling or sharing of your personal information to third parties. Upon receiving an opt-out request, we will act upon the request as soon as feasibly possible, but no later than fifteen (15) days from the date of the request submission.

Virginia CDPA Privacy Notice

Under the Virginia Consumer Data Protection Act (CDPA):

Upon receiving your request, we will respond without undue delay, but in all cases, within forty-five (45) days of receipt. The response period may be extended once by forty-five (45) additional days when reasonably necessary. We will inform you of any such extension within the initial 45-day response period, together with the reason for the extension.

Right to appeal

16. DATA PRIVACY & SECURITY

Formula Bot utilizes enterprise-grade best practices to protect our customers' data. We take our data privacy and security obligations seriously. Our platform, processes, and systems are designed to protect our users and their data. We have implemented information security controls in every part of our operations and we are consistently working to strengthen our stance.

Formula Bot builds on infrastructure with Amazon Web Services (AWS), OpenAI and Bubble.io, which provide industry-leading security, privacy, operation monitoring, and compliance.

This Data Privacy Policy outlines the measures we take to safeguard your data and explains how we collect, use, share, and protect the information you provide us. By using our services, you agree to the terms of this Data Privacy Policy.

User-Uploaded Data

When you upload data to our AWS platform, we collect and store the information you provide, which may include personal information, files, documents, images, or other data ("User-Uploaded Data"). We will only use User-Uploaded Data for the purposes for which it was uploaded and to provide the services you have requested. Our primary purposes for collecting and processing User-Uploaded Data include, but are not limited to:

a. Providing the services and features you have requested; b. Ensuring the security and integrity of the User-Uploaded Data; c. Complying with legal and regulatory obligations; d. Communicating with you regarding our services and updates.

When you use our product, you may encounter features that rely on third-party services such as Google Analytics and Google Sheets to deliver a comprehensive and efficient user experience. To enable these features and provide you with the best functionality, we may request your authorization to access certain data from these third-party services. By granting us this permission, you allow us to collect, analyze, and process specific data from your associated accounts, as described above.

Data Security

We take the security of your User-Uploaded Data seriously. We implement appropriate technical, administrative, and physical safeguards to protect your data from unauthorized access, disclosure, alteration, or destruction. These measures include but are not limited to access controls, data backup procedures, and regular security assessments. Data uploaded to the Data Analyzer is protected by encryption at the storage layer using the Advanced Encryption Standard (AES) algorithm, AES-256.

Data Retention

We will retain your User-Uploaded Data only for as long as necessary to fulfill the purposes for which it was collected or as required by applicable laws and regulations. Upon your request or termination of your account, we will delete or anonymize your User-Uploaded Data unless retention is necessary to comply with legal obligations. Files uploaded and conversations can be deleted by the user at any point.

Data Sharing and Disclosure

We will not sell, rent, trade, or otherwise share your User-Uploaded Data with third parties for marketing purposes without your explicit consent. In order to enhance the functionality and user experience of our app, we share files uploaded via Data Analyzer and all inputs/prompts with OpenAI. This data is used solely for the purpose of generating relevant code/outputs and is not used for any other purposes. The data uploaded to OpenAI is aggregated and anonymized and is NOT used to train the AI model.

OpenAI's API Data Policy

Our main service provider, OpenAI, mirrors our dedication to data security. OpenAI employs best-in-class technical protections and maintains robust encryption for data security in transit. Below, you'll find more about how OpenAI's security measures work to protect your information.

OpenAI will not use data submitted via their API to train or improve their models. Any data sent through to OpenAI via their API will be retained for abuse and misuse monitoring purposes for a maximum of 30 days, after which it will be deleted (unless otherwise required by law). The OpenAI API is SOC 2 Type 2 compliant and has been audited by an independent third-party auditor against the 2017 Trust Services Criteria for Security.
